1. Scope

1.1. These General Terms and Conditions (GTC) apply to all deliveries and services by LakeGIN in the version valid at the time of the order. In commercial transactions, we do not recognize deviating conditions unless we expressly agree to them in writing.
1.2. Customers in the sense of these terms and conditions can be both adult consumers according to § 13 BGB and entrepreneurs according to § 14 BGB, as well as professional groups with equal status.

3. Offer and conclusion of contract

3.1. The presentation of the products in the online shop is not a legally binding offer, but an invitation to order. Errors excepted.

3.2. By clicking the order button in the last step of the ordering process, you are placing a binding order for the goods listed on the order page, including these terms and conditions. The purchase contract is concluded when we accept your order by sending an order confirmation by email immediately after receiving your order.
4. Right of withdrawal for consumers

As a consumer, you have the right to revoke your contract declaration within two weeks without giving reasons in writing (e.g. letter, fax, e-mail) or - if the item is left to you before the deadline expires - by returning the item. Consequences of cancellation:
In the event of an effective revocation, the mutually received services must be returned and any benefits (e.g. interest) surrendered. If you cannot return the received service in whole or in part, or if you can only return it in a deteriorated condition, you may have to compensate us for the value. This does not apply to the surrender of items if the deterioration of the item is solely due to its inspection - as it would have been possible for you in a shop, for example. In addition, you can avoid the obligation to pay compensation for a deterioration caused by the intended use of the item by not using the item as if you were your property and by refraining from anything that could impair its value. Transportable items are to be returned at our risk. You have to bear the costs of the return if the goods delivered correspond to the goods ordered and if the price of the goods to be returned does not exceed an amount of 50 euros or if you have not yet received the consideration or contractually at a higher price of the goods at the time of the cancellation have made the agreed partial payment. Otherwise, the return is free for you. Items that cannot be sent as a parcel will be picked up from you. Obligations to reimburse payments must be fulfilled within 30 days. 4.1. Return costs when exercising the right of withdrawal
If you make use of your statutory right of cancellation (see cancellation policy), you will have to bear the regular costs of returning the goods if the goods delivered correspond to the goods ordered and if the price of the goods to be returned does not exceed an amount of 50 euros or if you pay a higher price have not yet provided the consideration or a contractually agreed partial payment for the item at the time of revocation. 5. Prices and shipping costs

5.1. The prices stated on the product pages include the statutory value added tax and other price components.

6. Delivery

6.1. The delivery takes place within Germany with DPD, or another provider of our choice.
6.2. The delivery time is approx. 1-3 working days.
6.3. The delivery and handing over of the goods takes place exclusively to persons of legal age.
We point out any deviating delivery times on the respective product page.
7. Payment

7.1. Payment can be made either by PayPal, ApplePay, credit card or direct debit. With the other available means of payment, the invoice amount is due at the time of the order and can be debited to the means of payment you have chosen immediately after the order process.
7.2. You are only entitled to offset if your counterclaims have been legally established by a court or are undisputed or have been recognized by us in writing.
7.3. You can only exercise a right of retention if the claims result from the same contractual relationship.
7.4. If there is a default in payment, the interest of § 288 BGB and possible dunning and legal costs are owed as damage caused by default.
7.5. When purchasing on account, your creditworthiness can be checked. This requires the passing on of the personal data required for this, which are provided by you in the course of the ordering process.
8. Retention of title

10. Protection of minors

In accordance with the Youth Protection Act, we do not sell wine to young people under the age of 16. Spirits are not sold to young people under the age of 18. By placing the order, the buyer confirms that he is of the required age according to the Youth Protection Act.

We save your order and the data provided to us in this context. We reserve the right to send you information in connection with your order by email.
12. Other

12.1. For all disputes arising from the contractual relationship, if the customer is not a consumer, the respective place of jurisdiction at the headquarters of LAKEGIN in 88048 Friedrichsafen applies. The statutory provisions apply to consumers if they deviate from them.
12.2. German law applies to the exclusion of the UN purchase law.
12.3. The contract language is German.
12.4. If one or more provisions of these terms and conditions are or become ineffective, the remaining provisions remain in force. Ineffective regulations are replaced by statutory regulations that come closest to the ineffective regulations economically. The same applies to loopholes in the contract.
